Estate Planning and Probate

Estate Planning

Estate planning can be an uncomfortable topic for some people, but a good estate plan is valuable because it:

  • Provides guidelines for anyone who needs to make financial or medical decisions on behalf of a family member;

  • Can protect assets through the use of a trust;

  • Can state specifically how assets are to be distributed;

  • Can minimize the need for a potentially complicated probate case;

  • Eases the burden on family members; and

  • Provide peace of mind that loved ones will be supported.

At Endurance Business Law, we strive to provide compassionate service to our estate planning clients by understanding the individual’s or couple’s goals and developing an overall plan that supports their goals and objectives. We customize each estate-planning document to the needs of the individual or married couple and structure the documents so they work together to achieve long-term goals and provide enduring results.

The most-common estate-planning documents are:

  • Last Will and Testament

  • Trust Agreement

  • Durable Financial Power of Attorney

  • Healthcare Powers of Attorney

  • Living Will (also known as an Advance Directive)

  • HIPAA Authorization

  • Other documents necessary to implement the plan such as a deed or assignment of an ownership interest in an LLC

Probate Cases

When someone passes away, the surviving family members are faced with the loss of a loved one but also may need to probate a will and/or take over administration of a trust. At EBL, we are experienced at helping clients during this difficult time and the process of probating a will, if necessary, and advising and assisting the successor trustee as he or she administers the trust. Our goal in the probate process or trust administration is to work with the client in a collaborative and efficient manner.
